Terms of Service

Welcome to Portiqis. These Terms of Service (“Terms”) govern your access to and use of the Portiqis website, applications, and services (collectively, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What Portiqis is — and is not
Portiqis is software. It is a self-service tool that helps you organize information and complete Canadian immigration forms. Portiqis is not a law firm, is not a licensed immigration consultant, and is not an authorized representative under section 91 of the Immigration and Refugee Protection Act (IRPA). We do not represent you before Immigration, Refugees and Citizenship Canada (IRCC) or any other tribunal or authority.
2. No legal or immigration advice
The Service provides general information and form-filling assistance. Nothing on the Service is legal advice or immigration advice. Information surfaced through Portiqis is general in nature and is not personalized to the facts of your case. For advice on complex matters — including refusals, inadmissibility, misrepresentation concerns, appeals, or judicial review — you should consult a Canadian lawyer or a consultant licensed by the College of Immigration and Citizenship Consultants (CICC).
3. Your responsibilities
You are solely responsible for:
- Program selection. Choosing the immigration program or pathway you wish to pursue.
- Eligibility. Verifying that you meet all eligibility requirements of the program you select.
- Accuracy. Ensuring every answer you provide and every piece of information that appears on a generated form is true, complete, and correct.
- Submission. Submitting your application, documents, fees, and biometrics to IRCC (or the appropriate authority) yourself.
- Account security. Keeping your account credentials confidential.
4. No client relationship
Your use of the Service does not create a solicitor-client relationship, a consultant-client relationship, or any fiduciary relationship between you and Portiqis or its personnel. Communications through the Service are not privileged.
5. Account and eligibility to use
You must be at least the age of majority in your jurisdiction (or have the consent of a parent or legal guardian) to use the Service. You agree to provide accurate registration information and to keep it up to date.
6. Fees and refunds
Some features of the Service are offered for a fee. Pricing is shown at the point of purchase. We offer a 14-day, no-questions-asked refund on eligible one-time purchases, calculated from the date of purchase. Refund requests must be sent to our support address. Refunds may not be available where required by law or where the refunded feature has been substantially consumed (for example, a generated and downloaded report). Subscription terms, if any, are disclosed at checkout.
7. Intellectual property
The Service, including software, content, designs, and trademarks, is owned by Portiqis or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial immigration purposes. You retain ownership of the information you submit, and you grant us a licence to process it solely to provide the Service.
8. Acceptable use
You agree not to:
- Use the Service to submit knowingly false information;
- Use the Service to provide immigration advice or representation to third parties for consideration in violation of IRPA s. 91;
- Reverse-engineer, scrape, or attempt to gain unauthorized access to the Service;
- Upload malicious code or content that is unlawful, infringing, harassing, or harmful.
9. Third-party services
The Service relies on third-party providers (for example, payment processors, AI providers, hosting and email infrastructure). Your use of those features is also subject to the relevant third party’s terms. We are not responsible for third-party services.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTIQIS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PORTIQIS DOES NOT GUARANTEE ANY IMMIGRATION OUTCOME.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTIQIS, ITS AFFILIATES, AND ITS PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PORTIQIS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) CAD $100.
12. Indemnity
You agree to indemnify and hold harmless Portiqis from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe doing so is necessary to protect the Service or other users. Sections that by their nature should survive termination will survive (including sections 2, 3, 4, 7, 10, 11, 12, and 14).
14. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute arising from these Terms or the Service, subject to any mandatory consumer-protection rights you have under your local law.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new “Last updated” date. Material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
